I would say the person doesnt have rights but who ever owns the copy rights needs to get ahold of ebay and then ebay will cancell every item description that the seller is using and might even suspend the seller if he/she has done this already in the past!
plans copyrights
I recently purchased a woodworking plans package from tedswoodworking.com. A part of that package is all of the plans off of the beesource website. Now, I dunno if he made some deal with Barry or anything, just thought I'd put an FYI out there. Don't know what other websites the owner of that website has ripped off assuming he does not have permission.

Its not ebay, its right off his website. $67 bucks upfront, or $47 is you try to walk away. And then more upsells on the backend.
I've been looking through the library and it looks like he has ripped off several websites. I'm demanding a refund, but I think someone who owns some of the copyrights needs to find a way to shut him down.

No deal was made!! All of the plans offered for free off Beesource come with a copyrighted notice on them. They may not be used for profit.
I would love to have my attorney contact this guy, but I would need to have the proof in my hands. If you would be willing to mail me the CD, I will either return it to you, or pay you. If you still have the packaging that it came in, that would be good to have as well.
I had no idea having this website would cost me as much as it does in legal fees. I'm either going after people who try to steal from here or defending myself from people who don't like what gets posted on the forums.

I just did the download portion, he wants another $20 plus shipping for the CD. I've been searching through a lot of the plans and they are from all over the net. Many are even screen scrapes from websites that they turned into PDF's. The product is offered through Clickbank, so there is some potential ability to shut them down through Clickbank.
I haven't requested the refund yet as I don't want to loose access in case you need anything else from the site. Might even contact some of the other sites he ripped off and see if there is anything that can be done jointly.
