Is there a problem using old wire embedded wax foundation? Other than it being brittle....is there a problem with the bee's building on it if it is not fresh?

I do not think there is any problem.

not really but if its from your own hives. used comb from some others hive scrap it. the risks for using used comb of unknowen orgins can include AFB, high chemicals, other problems. if you are not sure toss out the frames and melt the wax.
