I used window screen (metal) and used a stapler to keep the seam together.
OP, are you sure that it's a state law limiting you to 2 hives? I did a quick search but didn't see that. You should check this out....

From what I've seen, bees that drown in sugar water turn black. I've found them in my feeders before by the handful and every one of them was jet black.
Try to hive them and see what happens. Even if they don't survive winter, you'll have some frames of drawn comb to start with in the spring, and an extra few months of added knowledge.
